Interesting Call With NCO Financial Systems

So NCO called again tonight regarding my Capital One account. According to my Caller ID, they begin calling at 7:25 in the morning and their last call of the evening is about 8:55. Usually when I pick up the phone, there is no one there even if I wait a second or two. I hate automatic dialers so I generally don’t hang around on the phone for long.
They picked up pretty quickly tonight and I spoke with Emmanuel. He verified my name and I verified his. I then asked for NCO’s address. Dead silence on the phone and then he wanted to know why I was asking. What I really wanted to know was where to send the validation letter but I didn’t want to tell him. I told him that since they were calling in regard to a debt, I wanted to know their address. He put me on hold.
When he came back, he asked if I wanted to put a cease and desist order in. I said no, I wanted their address. He transferred me to his manager named Mohammed. Mohammed wanted to know whether I wanted to put a cease and desist order in and I said no, I wanted their address.
Asking for their address seems to make them very nervous. I finally got it but Mohammed wouldn’t let me off the phone without putting a cease and desist order on the account. They did tell me that I would have to send any payment or work out arrangements with Capital One.
This is fine with me as I have already sent Capital One an offer to pay off principal and interest less late charges and overlimit fees. I am going to send the validation letter to NCO referencing the Capital One account number anyway so that they cannot put anything on my credit report.
I have to tell you that this was the high point of my day! NCO has the RUDEST, MEANEST people on the phone and it was fun to put them on the spot for a change.

Lets face it, these companies work on intimadation and the fact that an overwhelming majority of folks have no idea about the banking rules and regualations when it comes to collection calls, etc. This is how they operate with borderline scare tactics, etc.
The fact that you calmly asked them for their mailing address and told them that you had done your homework and were protecting your rights.
The one thing I question is the 7:25 AM call, I thougth by Federal Law, they could not start calling until 8:00 AM? I know they can’t call after 9:00PM. Perhaps that needs to be put into your letter as well, they violated Federal Law.
Don’t you love Caller ID at times like these?

Sigh, then Cap 1 burst my bubble with a letter today saying they are going to take me to court for a judgment.
Of course, it was mailed long before my mailing the settlement offer. Hopefully they will settle it. I am really fighting hard not to have to declare bankruptcy.
Keep fighting the good fight and maybe Crapitol One will work with you. I failed in my negotiations (I also started wayy toooo late) and got wacked with a judgement. That is what drove me to the BK and if you can avoid the BK, do what you can.
